TOWNSHIP BOARD

September 10, 2002

Public Comment session was held at the Township Hall. Supervisor VanDyke called the meeting to order at 6:00 p.m.

Also present was Patricia Mason, Township Attorney, Marc Elliott, Township Engineers, and 1 interested person.

PUBLIC COMMENT

None.

DISCUSSION - POLICE DISTRICT

Trustee Worline presented 2001 crime statistics and additional information regarding the expansion of the police district.

There was lengthy discussion concerning the need for additional police protection, establishing a township wide special assessment district, holding a special election and other issues and concerns.

Motion by Worline, second by Bushouse to place the issue on the September 24th regular meeting agenda for further discussion. Carried.

Supervisor VanDyke called the regular meeting to order at 7:00 p.m. with the Pledge of Allegiance a moment of silence for September 11th.

Also present was Patricia Mason, Township Attorney, Marc Elliott, Township Engineers, Mary Lynn Bugge, Planner, Ken Howe, Fire Chief, Bob Horton, Building Official, and approximately 8 interested people.

Motion by Brown, second by Culp to approve the minutes of the August 27th meeting. Carried.

Income to the General and Fire Funds of $97,085.81 and disbursements of $188,957.42 were reported. Motion by Worline, second by Brown to accept the report as presented. Carried.

PLANNING COMMISSION RECOMMENDATION
REZONING - SECTION 33 - AG RURAL TO R-2

A rezoning request initiated by Richard Schramm for the residential portion of his properties on Yucca Point and expanded to include the properties at 8401 Stadium Drive and 4088, 4047, and 4055 O'Park Street was before the Board for Second Reading. The proposed rezoning would also include an amendment to the Master Land Use Plan to reclassify the above area from Rural Residential to Residential.

Motion by Everett, second by Worline to approve the rezoning and amend the Master Land Use Plan. Roll call vote showed Brown-yes, Bushouse-yes, Culp-yes, Everett-yes, VanDyke-yes, Worline-yes.

PLANNING COMMISSION RECOMMENDATION
REZONING - SECTION 35 - I-R TO R-5

A rezoning request initiated by Marv VanderVeen for property he owns on South 9th Street south of Atlantic Avenue, which adjoins the Huntington Run manufactured home community, was before the Board for First Reading.

Motion by Culp, second by Worline to set Second Reading for September 24th. Carried.

FINAL APPROVAL OF A FINAL PLAT - WEST PORT TRAILS #2

Planner Mary Lynn Bugge presented West Port Trails #2 for final approval advising all steps were complete with the exception of final approval of the Health Department.

Motion by Everett, second by Culp to grant final approval of the final plat subject to written final approval from the Health Department. Roll call vote showed Bushouse-yes, Culp-yes, Everett-yes, VanDyke-yes, Worline-yes, Brown-yes.

INITIAL AID RESPONSE AGREEMENT WITH CITY OF KALAMAZOO

An initial aid agreement with the City of Kalamazoo for fire/rescue emergencies was presented. In response to a question from Trustee Brown, Chief Howe advised personnel meet the state requirements for full time personnel. Ms. Brown commented this speaks well for our training program.

Trustee Worline commended Chief Howe for his work on the agreement.

Motion by Worline, second by Brown to approve the agreement and authorize the Supervisor to sign. Roll call vote showed Culp-yes, Everett-yes, VanDyke-yes, Worline-yes, Brown-yes, Bushouse-yes.

REPORT AND RECOMMENDATION FROM BUILDING DEPARTMENT
RESIDENTIAL/COMMERCIAL FEES

As requested by the Board at the July 9th meeting, Building Official Bob Horton presented a breakdown of commercial and residential expenses and revenues.

There was lengthy discussion regarding the application of the proposed formula, the number of commercial projects, the multiplier changes year to year based on previous year valuation, how much of the building department should be supported by the fees.

Motion by Worline, second by Everett to direct the Building Official to prepare a proposal for the permit fee multiplier using December, 2001 through November, 2002 valuations at 100% recovery, for consideration at the December 10th meeting. Carried.

OTHER BUSINESS

Engineer Marc Elliott advised it appears there has been a change with new drain commission office regarding the jurisdiction of catch basins and conveyance systems of storm water, which historically were owned and maintained by the Kalamazoo County Road Commission. He also advised that in the case of West Port Trails #2 the Drain Commissioner requested she retain authority to maintain and service the catch basins. He felt the Board should be aware since funding for the Drain Commissioner and Road Commission are different sources and this change could potentially have a local impact.

Dan Visser, developer of West Port Trails advised in Phase I they were instructed by the Drain Commissioner to cover the storm water grates with soil erosion fabric but after a heavy rain the streets flooded and the Road Commission told them to take the fabric off and the Drain Commissioner did not have jurisdiction over the storm grates and catch basins. He further advised after building the retention pond according to the approved plan and the Drain Commissioner's specifications, she refused to sign the necessary documents unless they agreed to maintain the pond for one year and guarantee it. He commented he hopes the Township hears him and can have some input regarding these situations.

Mr. Elliott also advised the Phase II Stormwater Group has a working draft template of the permit application to meet the requirements of the Federal Clean Water rules.

BOARD MEMBER COMMENTS

Clerk Everett advised leaf drop off days would be October 19th and November 9th from 9:00 a.m. to 3:00 p.m.

Trustee Worline commented he was very impressed with the graduation from the Fire Academy held at Fire House No. 2.

Supervisor VanDyke commented there will be an EPA information meeting at the Township Hall on October 2nd at 7:00 p.m.

There was no further business and the meeting was adjourned at approximately 8:05 p.m.
