ZONING BOARD OF APPEALS
February 29, 2000
The quarterly meeting of the Township Board, Planning Commission and Zoning Board of Appeals was held at the Township Hall. The meeting was called to order by Supervisor Fleckenstein at 7:00 p.m.

Also present was Mary Lynn Bugge, Planner and 2 interested persons.
SIGN ORDINANCE UPDATE
Mr. Dennie reviewed the proposed sign ordinance update. The updated ordinance would regulate signs more by use rather than by zoning district. Comments/questions from Board Members included wall signs when a building has protrusions, balloons as prohibited signs, signs on vehicles and political and non-commercial signs. It was noted that common sense should prevail in enforcement. The Planning Commission will further review these issues.
Brian Malony, owner of Rollerworld, commented that balloons launched at Flesher Field could be construed as distracting and a form of advertising. He further commented that a vehicle displaying advertising could have legitimate reasons for not being moved for several days.
Kadir Mohmand, 6147 Old Log Trail, commented that care should be given not to narrow the rights of people.
Attorney Richard Reed arrived.
PROPOSED RESOLUTION FOR PUBLIC MEETING CONDUCT
Attorney Reed presented a sample resolution addressing rules of order for public meetings. While acknowledging the right of the public to speak, rules need to be in place to insure an orderly meeting. Items discussed including time limits on public comment, inappropriate behavior or language, and the need to post or have the rules available in printed form. Attorney Reed suggested that each Board review the resolution and amend it to address their needs.
SIDEWALKS - SAMPLE ORDINANCE
Attorney Reed advised the Boards that new legislation has been enacted that lessens the liability of Townships regarding sidewalks. It was noted there are areas of the Township that would benefit greatly from having sidewalks. A sample ordinance was presented which could be used as a model. Consensus was to pursue this issue.
Attorney Reed exited the meeting.
INDUSTRIAL CLASSIFICATION UPDATE
Mr. Dennie advised that the Planning Commission is nearing the completion of a final draft regarding allowing office use in Industrial Zonings. Discussion centered on appropriateness of offices in I-R and I-1 zones, use of sub-standard size parcels, the potential for large scale industrial development in the future and consideration of rezoning some current I-1 to I-R. The Planning Commission will hold discussion on these issues.
ZONING BOARD OF APPEALS CONCERNS
Mr. Brodasky advised the ZBA has received several requests for variances regarding the 4 to 1 width to depth ratio requirement. It was noted that development and property splits have created irregular shaped parcels. He further commented that it would be a benefit to applicants if they would check with the Township Office before pursuing a project. Suggestions included a newsletter article, a memo to area realtors and item in the Gazette advising people to check with the Township Office before purchasing property for a particular use.
HISTORIC RESOURCES SURVEY
The historic resources survey of the Township has been completed. Planning Director Jodi Stefforia has suggested the next step be forming a committee of Township Board, Planning Commission members and any interested citizens to examine what can and should be done regarding those properties designated as historic. Trustee Bushouse and Mr. Corakis volunteered to form a committee for this purpose.
Mr. Loy advised that the next Oshtemo Business Association meeting will be held on March 15th at 7:00 p.m. at Pine West Catering. The guest speaker will be Mr. Josh Weiner and the meeting is open to the public.
Mr. Corakis advised the Association has purchased more flags for display in the Township.
There was no further business. The meeting adjourned at 9:05 p.m.
