TOWNSHIP BOARD

December 17, 2002

The Oshtemo Township Board held its work session at the Township Hall. Supervisor VanDyke called the meeting to order at 5:00 p.m.

Also present was Township Engineer Marc Elliott, Planning Director Jodi Stefforia, and Planner Mary Lynn Bugge.

Dan Frizzo of Prein & Newhof was present to review enhanced information now available from the GIS system. Planner Mary Lynn Bugge presented proposed fees intended to help defray the cost of expenses directly related to the provision of enhanced access. She also presented a review of current Planning Department fees and proposed increases, noting the last review was in 1994.

John Start of KATS was present to review with the Board the proposed areas for federal aid urban boundaries regarding road funding.

Supervisor VanDyke called the regular meeting to order at 7:00 p.m.

Also present was Patricia Mason, Township Attorney, Marc Elliott, Township Engineer, Jodi Stefforia, Planning Director, Mary Lynn Bugge, Planner, and 2 interested people.

Motion by Brown, second by Culp to approve the minutes of the December 10th meeting.

Income to the General and Fire Funds of $21,107.16 and disbursements of $123,883.33 were reported. Motion by Culp, second by Corakis to accept the receipts and disbursements report. Carried.

CITIZENS COMMENTS

None.

REZONING - SECTION 16 - AG TO C

A recommendation from the Planning Commission to rezone the eastern half of property located at 8403 West Main from "AG", Agricultural-Rural to "C", Local Business was before the Board for First Reading.

Motion by Culp, second by Everett to set Second Reading for January 14th. Roll call showed Brown-yes, Bushouse-yes, Corakis-yes, Culp-yes, Everett-yes, Rakowski-yes, VanDyke-yes.

COUNCIL OF GOVERNMENT (COG) DUES - 2003

Dues for 2003 in the amount of $300.00 were presented. Trustee Brown commented she feels the group has been effective and financially prudent.

Motion by Brown, second by Corakis to approve payment of 2003 COG dues in the amount of $300.00. Carried.

SEWER/WATER FEES

A recommendation from the Sewer/Water committee for an increase in sewer/water fees was reviewed at the December 10th meeting. It was noted while the increase is substantial, current fees do not cover current construction costs. There was also discussion that these fees should be reviewed annually.

Proposed fees for sewer:

Front foot fee - $35.00 per foot in excess of 100 feet
Parcel, lot, building site fee - $10,000 per parcel, lot, building site
Benefit unit fee - $2,000 per benefit

Proposed fees for water:

Front foot - $27.00 per foot
Lineal foot - $37.00 per foot
Hydrants, borings, topsoil/restoration-actual cost plus 15%

Motion by Culp, second by Rakowski to adopt resolutions establishing sewer/water fees effective January 1, 2003 and to be reviewed annually. Roll call vote showed Bushouse-yes, Corakis-yes, Culp-yes, Everett-yes, Rakowski-yes, VanDyke-yes, Brown-yes.

TOWNSHIP FEES

As reviewed at the Board work session, Planner Mary Lynn Bugge presented a recommendation for fees for enhanced access to public records; digital products, orthodigital prints, maps, and digital parcels.

There was also discussion that the resolution adopting the fees should include language that the information was not for resale, and the fees would be reviewed annually.

Motion by Culp, second by Brown to adopt a resolution establishing fees for enhanced access to public records effective January 1, 2003 and reviewed annually. Roll call showed Corakis-yes, Culp-yes, Everett-yes, Rakowski-yes, VanDyke-yes, Brown-yes, Bushouse-yes.

Ms. Bugge also presented a recommendation regarding department fees.

Rezoning - $600.00 for first acre and $50.00 for each additional acre up to $,2000.00

Master Plan Amendment - $500.00 plus cost as incurred

Clerk Everett advised fees for grave purchases had not been increased since at least 1989 and commented on the need for funds for cemetery maintenance.

Proposed cemetery fees:

Grave purchase - resident - $150.00 per grave

non-resident - $450.00 per grave

Cremation lot - $100.00 per lot

Motion by Culp, second by Rakowski to adopt a resolution establishing cemetery fees effective January 1, 2003 and to be reviewed annually. Roll call showed Everett-yes, Rakowski-yes, VanDyke-yes, Brown-yes, Bushouse-yes, Corakis-yes, Culp-yes.

There was also discussion of instituting fees for Industrial Facilities Tax Exemption (IFT), Liquor License, and Payment in Lieu of Taxes (PILOT) applications.

Motion by Bushouse, second by Rakowski to table this item to January 14th for further study.

BUDGET ADJUSTMENTS - 2002

Adjustments to the 2002 budget as prepared by Clerk Everett and Township Auditor Mike Crandall were presented.

Motion by Culp, second by Brown to approve the adjustments to the 2002 budget. Roll call vote showed Rakowski-yes, VanDyke-yes, Brown-yes, Bushouse-yes, Corakis-yes, Culp-yes, Everett-yes.

ENGINEERING, FINANCIAL, LEGAL CONSULTANTS AND DEPOSITORIES FOR 2003

Attorney Mason advised the Reed, Stover firm will be merging with Lewis & Allen to become Lewis, Reed, Stover & Allen. She also advised she would meet with the Board at a January work session to review annual activity. Engineer Elliott advised he would be happy to meet with the Board for the same purpose as well.

Motion by Everett, second by Brown to appoint for 2003 Prein & Newhof as Township engineers, Siegfried, Crandall Township financial consultants, Lewis, Reed, Stover & Allen as Township attorneys, and approve the list of depositories as presented by Treasurer Culp. Roll call showed VanDyke-yes, Brown-yes, Bushouse-yes, Corakis-yes, Culp-yes, Everett-yes, Rakowski-yes.

MEETING DATES - 2003

Meeting dates for 2003 were presented using the current schedule, 2nd Tuesday at 6:00 p.m. and 4th Tuesday at 7:00 p.m. with a 5:00 p.m. Board work session, the exception being the second meeting of January will be held on the 21st and first meeting of November will be held on the 4th. Joint meetings with the Planning Commission and Zoning Board of Appeals will be held on the third Tuesday of February, May, August and November at 7:00 p.m.

Motion by Brown, second by Culp to approve the meeting date schedule. Carried.

OTHER BUSINESS

Attorney Mason presented a resolution and letter from the Supervisor to be sent to MDEQ expressing the Township position regarding the KL Landfill.

Motion by Brown, second by Everett to adopt the resolution. Roll call vote showed Brown-yes, Bushouse-yes, Corakis-yes, Culp-yes, Everett-yes, Rakowski-yes, VanDyke-yes.\

BOARD MEMBER COMMENTS

Trustee Rakowski requested a copy of the property maintenance code.

Mr. Rakowski advised he would be discussing with Fire Chief Ken Howe insurance reimbursement that can be sought for fire department "clean-up" of auto accidents.

Trustee Bushouse commented the larger rental properties should be advised of the rental housing registration ordinance.

There was no further business and the meeting was adjourned at approximately 8:10 p.m.
